End of Season Fun

            Last week, the Garretson Volunteer Fire Department gave kids a season ending game to remember. After the final girls' softball coach pitch game of the season, Todd Fink and Tony Olson from the Garretson fire department sprayed the kids off for fun. It was a fun way to celebrate another season of youth softball and baseball.

            The Split Rock Farmer's Market is in its second year, and just like last year, it has been a resounding success! July's Market is coming up next Tuesday, July 9 from 6:00-8:00 p.m. with plenty of vendors, ensuring there is something interesting for everyone.

            Listed vendors currently include Jamie's Braids, Pack'n Heat salsas, Farm 484, Glean for Good, Mary's Mountain Cookies, Zells Farm Fresh Eggs, Moll Doll Designs, Heavenly Food LLC, Mama Ledas, and Styles n Scents. 65th Class Reunion for Class of 1959

            "Rain, rain go away, come again another day" was the feeling of the Class of 1959 as they climbed into a horse drawn wagon driven by Gregg Kringen at the Jesse James Day Parade. This was the fourth 1959 class reunion that has ridden in this green wagon. Several chose not to sit in the rain but the sprinkles stopped just before the parade started so off they go.

     A few class members toured the museum after the parade for over an hour, expressing how clean and well organized it was. They also were pleased with the new railroad room.  Around 4:00 the class members met at the American Legion to start visiting. The tables were set with royal blue runners, star lights and centerpieces.  Another table had annuals, high school scrapbooks, class reunion books and other memory items.  The class graduated 29. Nine have passed away and twenty are living, with this year's attendance at thirteen.

     Before eating, Sharon Plahn Kringen welcomed them.  She told them they were "a rock in life" in story form.  Gladys Hinds Ambroson was thanked for helping Sharon with mailing reservations, updating the address list and putting the centerpieces together. The centerpieces were given by the answer to the question "Who did?". For example, who has visited the most countries?  Charlotte Johanson Bowlds won with 17. After the centerpieces were given, Sharon said a prayer before they ate. County Fair served a delicious 2-meat meal with all the trimmings.  Three classmates brought dessert to be served, which was appreciated.

     A night of visiting ended at 8:30 p.m., past bedtime for these elderly people.  All left wondering if they will be here for a 70th reunion.  Sharon reminded them of our graduation song, "God Be With You Til We Meet Again." Set a goal and keep well for the 70th.  Those that came from a distance were David Thompson (California), Kay McDonald (California), Charlotte Bowlds (Colorado), and Dale Busch (St. James, Minnesota).

Nancy Grandy Legionnaire of the Year

            Henry G. Fix American Legion Post #23's own Nancy Grandy was named Legionnaire of the Year at the 105th Annual Department of South Dakota American Legion Convention held June 20-23 in Pierre.  Grandy is a Past Post Commander (2022) and currently serves as Service Officer and Post Newsletter Editor.

            She was elected Post #23 and District 7's Legionnaire of the Year back in April, and went on to be named Legionnaire of the Year for the whole of South Dakota during the annual convention.

16U plays five games vs. Baltic, Beresford and Tri-Valley

            After winning against a Baltic doubleheader on Wednesday, June 26, the Garretson 16U baseball team had a tough run of luck against the Beresford Post 72 CBAH teams and the Tri-Valley Mustangs Maroon on Friday and Monday.

            In the first game against Baltic on the opponent's field, the Garretson team watched as Baltic gathered four points in the first two innings. The scrappy team made a comeback in the top of the third, scoring 7 runs and taking the lead before Baltic tied the score with three of their own. Garretson again battled back and scored five at the top of the fourth while keeping Baltic to one, but Baltic kept Garretson to one while getting three of their own in the fifth inning. In the top of the sixth, Garretson's Dan Hoskins doubled on a line drive to center field, sending Isaiah Coburn home. Baltic was unable to make up the difference at the bottom of the inning, and Garretson took the win 15-11.

            In the second game, Garretson was again victorious, 10-6. Aiden Johnson got Garretson on the board at the top of the first inning when he stole home. Later in the inning, Joey Bey Tonsay also stole home, gathering Garretson second point of the game.

            Despite Baltic scoring three at the bottom of the second and third innings, Garretson kept the lead throughout, scoring two in the second, three in the third, and three in the fourth inning of the shortened game.

            On Friday, the team headed down to Beresford for a double header against Post 72 CBAH, and found themselves down in both games. In the first, Garretson's Ian Buettner scored when Cole Jessen hit a fly ball and reached on an error by the first baseman, but they were unable to advance further until the sixth inning.

            The team kept Beresford down at zero until the bottom of the fifth, when two errors allowed CBAH players to cross home plate. They finished the game at the bottom of the sixth, surpassing Garretson by gathering two more points on a double fly ball to center fielder Buettner and ending 2-4.

            The second game with Beresford saw the opponents take the lead at the bottom of the second, and despite five runs at the top of the fourth, Garretson was unable to catch up to CBAH's 8 points in the third and five points in the fourth, ending the game 6-16.

            Riley Lafferty-Maack put Garretson on the scoreboard first at the top of the second inning, when he crossed home on a passed ball. He crossed again on a passed ball during the five-point fourth inning, which also saw Collin Olson, Dylan Waltman, Bey Tonsay, and Elijah Winterton score. Both Bey Tonsay and Winterton scored on steals.

            On Monday, the team hosted the Tri-Valley Mustangs Maroon, and despite a strong hit game, were unable to overcome the Mustangs, walking away with a score of 11-15.

            Both teams were on the board by the end of the first inning, sitting at 2-1. However, Tri-Valley pulled ahead at the top of the third, acquiring five runs while Garretson scored one. The team was unable to overcome that lead, though they scored five at the bottom of the fifth, bringing the score to 9-13. Despite two more at the bottom of the seventh, it just wasn't enough to beat Tri-Valley.

            Garretson was scheduled to play Canton on Tuesday at home during the Legion's Independence Day celebration (results not available at press time) and host another double header against Volga on Wednesday. They'll be heading to Hamlin on Friday and heading north on Saturday to Volga and Brookings to take on New Ulm, MN and Aberdeen at 9:00 a.m. and 2:00 p.m.

Jays Win in a Wild Night at the Park!

            On June 25, the Garretson BlueJays came to play the Renner Rangers on the home field. The concessions were locked and the ump needed to use the bathroom, but luckily Cody Linwebber showed up unlocking the facilities!

            Cole Koch started on the mound and saw his ERA balloon from 1.3 to 59.6, giving up 8 runs in two innings due to multiple errors and walks. Assistant coach Brady Bonte played third, letting the young buck Flanny catch. Sam Quantaince was called off the farm to play first with a bad back and got beamed twice in the back with bases loaded, putting the Jays over his own health. #Gamer! Bohl was in right and was not impressed with the Jays looking like an 11U team, making more mistakes than Brady debates did on a high school math test.

            We had three web gems in the outfield: Nick Bonte, Jayse Miller, and Scott Splett. Coach Vanhove came in the second and threw an absolute gem, throwing gas and allowing maybe 1-2 hits at most. Tayson hit a hard liner to left to score a couple of runs, and Steckler played a good short after a big error in the first. Hot dogs were made by Cole Koch’s dad, and the candy and drinks were served by his mom!

            On a serious note, it was Tay It Forward at the ballpark! Garretson seems to amaze me more and more as I get older a great town that supports one another and really has great people in the community willing to go the extra mile. The Jays are now 3-4 on the year.

Winning again

            The Jays won 29-0 against the pesky Parker Ringnecks on Sunday, June 30. The Jays racked up a total of 33 hits, probably more than all of last year combined.

            Coach Vanhove took the mound again and made the most of it, throwing a one-hitter which is still being questioned whether it was an error at short or not. Trey Buck was showing off his pipes before and after the game to the ladies, hitting two doubles off the wall during the game. Scott Splett had three doubles, and Brady Deballs put his trusty contacts in and got a couple of hits. Tayson was rocking a mustache, and he and Koch reached base every time. Brady Bonte let the young gun Flanny catch while he played right, and he might be a natural. Flanny's grandma hasn’t shown up since she gave out the last of her Werther's at the second game of the season. Nick Bonte stopped a couple of grounders at second, and Jack Sparrow was a no-show.

            The Swateks ran the concessions and were hearing it from the fans about how slow the hot dogs were getting cooked on the grill. Cody Linwebber, 2008 class president, unlocked the bathrooms again, and Blue Jay Hall of Fame umps Tad and Todd did the umpiring.

            The Jays are off until 7/7, enjoy the 4th and if you have any questions you can give assistant coaches Bohl and Frewaldt a call! They'll be back on the home field at 7:00 on July 8 to put Flandreau in its place!

One Win, One Loss for 14U

            Last week Wednesday, Garretson 14U hosted Flandreau and had a hard time overcoming the seven points the opponents collected in the first inning. Flandreau took home the win, prevailing with 11 points to Garretson's 1.

            Garretson collected its single point at the bottom of the second inning, when Jacoby Costello scored on a wild pitch to Casen Smith.

            Chase Costello had three successful hits in three at bats. He also opened for the Garretson team, facing 6 batters and walking five, allowing zero hits.

            Also toeing the mound were Brock Bonte and Gavin Coburn, who each pitched three innings. Bonte struck out five, walked four, and allowed one hit. Coburn struck out one, allowed four hits, and walked zero.

            On Friday, the team brought Volga White to the home field, and prevailed 8-1 despite Volga getting on the board in the first inning.

            Garretson brought four over home plate in the bottom of the second, with the first happening when Blake Benson scored on a line drive to center from teammate Cooper Smith. Coburn scored on a passed ball and Ty VanHolland scored when Zach Hermanson grounded out to the short stop, and Smith scored when Cade Risty grounded out and reached first on an error by the third baseman.

            Now in the lead, the two teams battled it out over the next four innings, but Garretson cinched its win with four more runs at the bottom of the sixth. J. Costello again crossed home plate on a walk, and Coburn scored on a wild pitch. C. Costello doubled on a line drive to center field, sending VanHolland and Smith home and placing the score at 8-1. Garretson defense kept Volga from taking any more points when Cooper Smith and VanHolland each caught pop flys, and shortstop Coburn stopped a grounder with enough time to tag Volga player L. Langland out.

            Starting on the mound for Garretson was Casen Smith, who pitched all seven innings. He struck out one, walked one, and allowed five hits.

            Garretson 14U got 7 hits and 5 runs batted in, with C. Costello hitting three out of three at bats and Cooper Smith hitting two out of two at bats.

            Garretson was scheduled to play Canton 14U at home on Tuesday as the American Legion celebrated Independence Day (results not available at press time), and will play its final game of the regular season next Tuesday in Madison.

Petitions filed to refer carbon pipeline law to ballot; Summit plans to reapply for SD permit

South Dakota voters might decide on Nov. 5 whether to reject a new state law regulating carbon dioxide pipelines.

The ballot measure committee known as the South Dakota Property Rights and Local Control Alliance submitted an estimated 28,000 petition signatures to the Secretary of State’s Office on Monday, said Jim Eschenbaum, chairman of the organization. The group needed signatures from 17,508 registered South Dakota voters by today’s deadline. The Secretary of State’s Office will now sample the signatures to determine if enough of them are valid.

The group aims to refer Senate Bill 201, which the Legislature and Gov. Kristi Noem approved last winter. Supporters said the legislation will implement new protections for local governments and landowners while providing a path forward for pipeline projects. Opponents view it as a capitulation to pipeline companies.

The bill came in response to an $8.5 billion pipeline proposed by Summit Carbon Solutions, which is headquartered in Iowa. The pipeline would collect carbon dioxide from 57 ethanol plants in South Dakota and neighboring states and pipe it to North Dakota for underground storage. The project could benefit from federal tax credits that incentivize carbon sequestration to fight climate change. 

The Iowa Utilities Board approved Summit’s project Tuesday. The company announced shortly afterward that it plans to apply again for a permit in South Dakota next month, after its initial application was denied last year by the Public Utilities Commission. The company’s pipeline application in North Dakota is under consideration, and it still needs an underground storage permit in North Dakota.

The South Dakota denial was partly due to conflicts with county ordinances that require minimum distances known as “setbacks” between pipelines and other features. The project has also faced opposition from some landowners concerned about property rights and safety, including health risks associated with potential leaks.

Property rights were a factor in several Republican primary races in eastern South Dakota earlier this summer. Out of 14 incumbents who lost their seat, 11 of them voted for SB 201.

“I think people realize now that people are paying attention and maybe want representation in Pierre that won’t be sellouts to corporate America,” Eschenbaum said.

What the law says

Among the protections in the new bill is authority for counties to collect a pipeline surcharge of up to $1 per linear foot, with at least half of the surcharge allocated for property tax relief for affected landowners. The remaining funds could be used at the county’s discretion. Companies also must submit an agricultural impact mitigation plan and bury pipelines at least 4 feet deep.

The bill mandates public disclosure of modeling to gauge the impact of a pipeline rupture and ensures that pipeline companies, rather than landowners, are liable for damages caused by the projects.

In response to controversy about out-of-state contractors working for pipeline companies, the law says a land agent must be a pipeline facility employee, a resident of the state, or a real estate agent licensed in the state.

House Majority Leader Will Mortenson, R-Fort Pierre, was the prime sponsor of the bill in the House. The legislation provides additional property rights and money for farmers and counties, Mortenson said. He encouraged voters to support the law if it’s certified for the ballot.

“If you don’t think the pipeline should be held accountable, you should vote no. If you don’t think farmers deserve additional compensation, you should vote no. If you don’t think counties deserve additional compensation from these pipelines, you should vote no,” Mortenson said. “But if you want farmers protected and counties benefited if these pipelines are built, you should vote yes like the Legislature did and the governor approved.”

Setback language

The most controversial part of the new law is its language about the Public Utilities Commission and local setback laws. Prior state law allowed the commission to overrule counties’ pipeline setbacks, although the commission has so far declined to do that. 

The new law says a permit from the commission automatically overrules local setback laws, unless the commission specifically chooses to uphold them.

“It took the voice away from county commissioners and gave it to three people in Pierre,” said Eschenbaum, who is a Hand County commissioner. “They basically say we’re not smart enough, that we don’t understand. I think it’s an awful precedent to set.”

Finally, the legislation codifies a “Landowner Bill of Rights” that includes references to rights in other South Dakota laws, including two other pipeline-related bills passed during the most recent legislative session.

If the law is referred to voters, it would join six other measures already approved to be on the ballot.

Joint meeting for the Minnehaha County Commissioners and the City Council of Sioux Falls for June 25, 2024

            THE MINNEHAHA COUNTY COMMISSION CONVENED AT 5:00 PM on June 25, 2024, pursuant to adjournment on June 25, 2024. COMMISSIONERS PRESENT WERE: Bender, Bleyenberg, Karsky, and Kippley. Commissioner Beninga was absent.  Also present were Kym Christiansen, Commission Recorder, and Maggie Gillespie, Senior Deputy State's Attorney.

            City Council Members present: Barranco, Basye, Cole, Merkouris, Sigette, Spellerberg, Thomason. Council Member Soehl and Mayor TenHaken were absent. 

            Chair Karsky called the meeting to order.

            MOTION by Kippley, seconded by Bleyenberg, to Approve the Agenda. 4 ayes. The City concurred.

ZONING TEXT AMENDMENT

            Scott Anderson, Planning Director, was present for the public hearing and gave the second reading on an ordinance amendment to clarify long-term lease or rental of property in the joint jurisdiction. The proposed amendment would add a section to the Additional Use Regulations that states that it is not the intent of the Joint Zoning Ordinance to prohibit the long-term lease or rental of property provided the use is legal. This would apply to the lease of property such as farmland, mini storage units, residential leases and other long-term rental or leases of property. Both the Minnehaha County and City of Sioux Falls Planning Commissions unanimously approve the text amendment to the Revised Joint Zoning Ordinance of Minnehaha County and the City of Sioux Falls. 

            Chair Karsky asked for the proponents and opponents to speak on the topic. There were no proponents or opponents in attendance to speak on the topic.

            MOTION by Bender, seconded by Kippley, to Approve Ordinance MC 30-51-24, An Ordinance of Minnehaha County, SD, Amending the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls by Amending Article 15 to Include Long-Term Lease or Rental Regulations.  By roll call vote: 4 ayes. The City concurred.

            The entire ordinance is on file at the Auditor's Office.

FACT OF ADOPTION

RESOLUTIONS

            Upon the request of Kris Swanson, Treasurer, MOTION by Bleyenberg, seconded by Kippley, to Approve Resolution MC24-14 to Declare Certain Mobile Home Distress Warrants for Unpaid Property Taxes as Uncollectible. By roll call vote: 4 ayes. The list of mobile homes is on file at the Auditor's Office.

RESOLUTION MC24-14

RESOLUTION TO DECLARE CERTAIN MOBILE HOME DISTRESS WARRANTS FOR UNPAID PROPERTY TAXES AS UNCOLLECTIBLE

            WHEREAS, SDCL 10-22-30 provides for the county Boards of Commissioners to discharge all distress warrants deemed by the sheriff to be uncollectible; and

            WHEREAS, The Office of the Minnehaha County Treasurer has provided an attached list of 13 mobile homes identified as uncollectible, and

            WHEREAS, by declaring the property taxes for these mobile homes as uncollectible, these taxes will be added to an uncollectible list and no distress warrant shall thereafter be issued therefore except on order of the Board of Commissioners or on written demand by the sheriff;

            NOW THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners that property taxes on the attached list of mobile homes are declared as uncollectible pursuant to SDCL 10-22-30.

            Upon the request of Meredith Jarchow, Assistant Commission Administrative Officer, MOTION by Kippley, seconded by Bleyenberg, to Approve Resolution MC 24-15 Authorizing Administrative Officer to Execute Change Orders Relating to the Juvenile Justice Center Project. By roll call vote: 4 ayes.

RESOLUTION MC 24-15

            RESOLUTION AUTHORIZING ADMINISTRATIVE OFFICER TO EXECUTE CHANGE ORDERS RELATING TO THE JUVENILE JUSTICE CENTER PROJECT

            WHEREAS, Minnehaha County commenced a Juvenile Justice Center Project (“the Project”) in April of 2024 with an anticipated completion date in November of 2026; and

            WHEREAS, Minnehaha County has engaged TEGRA Group as the Owner’s Representative of the Project; and

            WHEREAS, Minnehaha County has engaged Henry Carlson as Construction Manager At-Risk; and

            WHEREAS, the Minnehaha County Board of Commissioners recognizes that due to the scope of this public improvement project, circumstances may arise which will necessitate the execution of change orders; and

            WHEREAS, the Minnehaha County Board of Commissioners seeks to avoid impediments to the expeditious completion of the Project; and

            WHEREAS, the Minnehaha County Board of Commissioners finds that it is the best interests of the County to delegate the responsibility for approving or denying change orders in an amount not to exceed $100,000.00, so as to not incur unnecessary delay in postponing consideration of each change order to a regularly-scheduled Commission meeting; and

            WHEREAS, pursuant to Article 2.1.1 of the General Conditions Contract approved on the 23rd day of October, 2023, the Owner may designate a representative who shall have express authority to bind the Owner with respect to matters requiring the Owners approval; and

            WHEREAS, the Minnehaha County Board of Commissioners finds that it is in the best interests of the County to exercise this authority for the sole purpose of change orders as limited herein; and

            WHEREAS, the Minnehaha County Board of Commissioners finds that it is in the best interests of the County, in delegating its authority to approve or decline change orders related to the Project, to establish internal controls as provided herein;

            NOW THEREFORE BE IT RESOLVED, by the Board of Commissioners of Minnehaha County, South Dakota, as follows:

            1.         Subject to the restrictions set forth herein, the authority to approve or decline any requested change orders as may reasonably be necessary to keep the Project on schedule is hereby delegated, pursuant to Article 2.1.1 referenced above, to its Administrative Officer, Tom Greco, or, solely in the event he is unavailable due to authorized absence, to the Assistant Administrative Officer, Meredith Jarchow; and

            2.         The scope of the authority to approve or decline any change orders as described in Paragraph 1, is limited, in that, in no event shall the Administrative Officer or the Assistant Administrative Officer acting in his stead, approve any individual change order in an amount exceeding $100,000; and

            3.         The scope of the authority described in Paragraph 1 is further limited, in that, the Administrative Officer, or the Assistant Administrative Officer acting in his stead, shall consult with a representative of TEGRA Group, the Minnehaha County Juvenile Detention Center Director, and the Minnehaha County Director of Facilities, on any requested change order prior to executing or declining said change order of any amount and; further shall receive a written request for approval or concurrence from a representative of TEGRA Group, the Juvenile Detention Center Director, and the Director of Facilities, prior to executing or declining any change order of any amount; and

            4.         The scope of the authority described in Paragraph 1 is additionally limited, in that, the Administrative Officer, or the Assistant Administrative Officer in his stead, shall receive written approval from at least one of the designated Commissioner Liaisons to the Project, prior to approving or declining any change order of any amount; and

            5.         Prior to approving any change order relating to the Project, the Administrative Officer, or the Assistant Administrative Officer acting in his stead, must make a written determination that the change order is in the best interests of the County and is authorized by law; and

            6.         This written determination and the written change order shall be retained in the contract file which shall be open to the public for inspection; and

            7.         In no event shall the sum of any proposed change order plus the sum of all other prior unbid change orders, exclusive of change orders which meet either of the criteria set forth in SDCL 5-18B-19(1) or (2), exceed the greater of two hundred fifty thousand dollars or five percent of the base contract; and  

            8.         Prior to approving any change order of any amount, the Administrative Officer, or the Assistant Administrative Officer in his stead, is encouraged, but not required, to consult with the Office of State’s Attorney to ensure compliance with relevant procurement laws; and

            9.         The Board of Commissioners reserves its right to revoke in its discretion this delegation of authority at any time.

FY2025 BUDGET FOLLOW UP

            Susan Beaman, Finance and Budget Officer, presented a briefing regarding the 2025 budget follow-up. The items discussed included a review of the outside agency changes, review of updated means of finance, and long range financial projection updates as well as the need for a potential opt out.

            Steve Groen, Highway Superintendent, provided an update regarding the status of county roads due to the recent flooding.

            Commissioner Kippley reported on the recent meeting of the Minnehaha County Planning Commission.

            Commissioner Bender thanked all the residents who worked during the recent primary election.

            Commissioner Kippley thanked the members of the recount board for their work.

            Commissioner Bleyenberg thanked all the volunteers as well as Emergency Management for their work during the recent flooding.

            MOTION by Bender, seconded by Kippley, to Enter into Executive Session Pursuant to SDCL 1-25-2 (1), (3), (4),  and (6) at 9.54 a.m. 4 ayes.

            Chair Karsky declared the executive session concluded at 10:15 a.m.

            MOTION by Bender, seconded by Kippley, to adjourn at 10:16 a.m. 4 ayes.

            The Commission adjourned until 5:00 p.m. on Tuesday, June 25th, 2024.

Full Bar and Food Trucks available onsite for purchase (not included with admission). Must be 21 and older to enter. Tables are $300 and seat 8. Individual tickets are available for $40.

Flooding hits Garretson area, but not as bad as it might have been

            Record rainfalls hit the region last week and there was flooding everywhere. In the Garretson area, we got by a lot better than some other places nearby, like Dakota Dunes to the south, and Rock Valley, Iowa to the southeast. Estimates and measurements vary, but over a seven-day period the Garretson area received between eight to ten inches of rain, with the worst being Thursday evening, June 20 through Friday, June 21st, where over four inches fell in a short span.

            “Honestly, we got pretty lucky,” said Payten Dreckman, Garretson City Finance Officer. “On Friday we shut down the north end of Split Rock Park, evacuated campers and barricaded off every camping area affected by the flooding. We had Vandersnick Excavating clear the crappie bridge of wood and detritus because it had been clogged and water wasn’t flowing through it. We were closely watching our lagoons, but so far everything has worked fine and we haven’t had to institute any water restrictions, everything was working at capacity and we were okay. It was certainly a busy time, and it kept everyone on their toes, but we did pretty well for ourselves, especially when we consider other nearby communities to the south of us and in Iowa and Minnesota.”
